Khula divorce rights

Should a Muslim woman be able to seek 'khula' divorce without her husband's consent?

📍 Kerala, India

On 6 October 2026 the Kerala High Court held that a husband's consent is immaterial when a Muslim wife invokes extra-judicial divorce by khula, and that the family court need not conduct a detailed inquiry. The Supreme Court has separately considered referring challenges to talaq-e-hasan to a larger bench.
